He's in state court because he's under the monetary minimum for claimed damages. It is a dumb lawsuit IMO. He's alleging fraud, according to the ESPN article. That involves intentional conduct-not a mistake no matter how egregious the call may have been. It WILL be thrown out and there will be no recovery.
I guess "a precedent has been set" was assuming it goes to trial. So I hope you're right and it does get thrown out. Thanks for the reply.
