This is just another in an endless series of frivolous lawsuits that bogs down the courts and costs defendants untold sums of money to defend all kinds of nonsense contingent on questionable legal theories and just plain silliness, vendettas, or a what-the-heck throw it against a wall and see what sticks strategy. In fact, often the purpose is to simply wreck havoc on a defendant's pocket book in order for some kind of revenge, or for some two bit lawyer to make a name for himself. Or for some deep pockets defendant like the NFL to fork over some money just as a pragmatic matter because it would be cheaper than going forward.
So, legal eagles, what could possibly be a reasonable (NOT contrived is-there-life-on-other-planets) basis for allowing a lawsuit over a non-called penalty in an NFL game to go forward to civil trial? Any precedence for that?
Judges have leeway to make common sense decisions..... although today you wouldn't think so. In fact, at the other end of the spectrum are judges making legal decisions that are in fact effectively creating new law.
Granted, it's not my money and not my problem. But if you've ever been involved in a frivolous lawsuit as a defendant, as I was (at least it was a suit against my employer and not me personally), and see the costs involved perhaps you might feel a little less holier than thou.
And as for my hyperbole according to our noted Board king of generality and anecdotal evidence that masquerades for fact..... talk about the pot calling the kettle black. Besides, I stand by my rant. I do hate this about our legal system and it needs to change; such as making a plaintiff pay all defense attorney costs and court fees for a case dismissed because it is frivolous.
