It is absolutely a state power. That power--and the fact that it IS a state power--is not only dictated by the constitution but upheld by supreme court decisions. The 10th amendment grants states power to establish and enforce laws protecting the welfare, safety, and health of the public.
Anyway, either way, Waterfield did not
say it was a federal power. Though some of the examples he lists were federal but not all of them are.
Since the feds are making no effort to mandate anything regarding the vaccine and in fact are not even thinking about that, it's a non-issue.
But yes it's a constitutionally established and supreme-court back state power to make and enforce laws protecting public health and safety.
