You're probably right about the tox screen holding up the charging decision.

He will likely have some form of opiates in his blood if he follows the typical pattern maybe some marijuana which could affect him with the league --but the fact remains a good forensic toxicologist will eat that up.

I've never known a good defense attorney to lose a DUI with drugs.
