Walking with a phone and ear buds?

listening to music or something with those earbuds? I see nothing else for a reason really, or maybe he was crossing the road or walking down the road. Was he walking down the road facing the traffic or his back to the traffic? If his back was to the traffic he would not see the truck coming from behind. If he was walking close to the edge of the road...blammy....Don't think he would be under the influence....if he was chances are he would be behind a wheel...IMO.
