If I'm not mistaken, there's a bill pending in Cali that would give prosecutors discretion to charge drivers involved in street racing that results in a fatality with a felony.

And though I wouldn't put it past a local prosecutor for giving a high-profile defendant a break in this respect, I also think there are a number of DDA's out there who'd have no problem with filing a felony.

This kid is lucky.
