have Covid so cleaning out some closests and found an old first year exam in Tort liability. Here's the opening Q:

A driver has robbed a bank and is fleeting the police. Robbers car approaches a railroad intersection whose signals are not working and there is no knowledge of an approaching train that is exceeding the regulatory speed limits for trains in a residential area. A woman is crossing the train tracks with her children in order to get to a drug house. The train hits the woman killing her and her children. The train then derails and runs into an ammunitions factory causing an explosion and fire that burns nearly half an industrial supply center that was getting ready to deliver life saving medicine to an indiginous population in Alaska.

Discuss liability including but not limited to intervening and superseding causes. Compare your California analysis with the laws of all states west of the Mississipi River.
