As I read the article, the contaminated soil is gone.

The current lawsuit is over who should have to pay what for the cleanup that has already taken place.

The article isn't crystal clear about that though, perhaps due to the incompetence of journalists, but also because you get more clicks by implying danger than by describing an insurance lawsuit.

And in any case, you'd probably have to eat the soil or drink water that had been in the soil to get arsenic poisoning. Not just be in the general vicinity.
