Burglary of any structure where people dwell or habituate is a first degree burglary regardless, the “wobbler” unlike a Warner pass applies when someone enters nonresidential type structures ie., commercial building with intent to commit theft, then value comes into play to determine if it’s a felony or a misdemeanor. This prevents minor shop lifting being charged as a felony.
