I don't see where the ACLU has any grounds to get involved with a NFL team on Kaps perspective. A business disciplining for religious reason violates federal law, not the 1st Amendment.
A high school on the other hand would be violating the 1st Amendment if they tried it. This issue is cut and dry established precedent. My guess is the ACLU would send the high school a letter, then the High School would say ... oops ... our bad ... the kid can sit during the Anthem if he wants.
