Yes it is a choice, but there is an addiction issue with his drinking IMO. Many of us choose to drink as well, but we don't go to excess. IMO when it becomes an addiction issue you really don't have the ability to actually choose to drink, you have the need to do so. That said IMO He should do jail time, not just lose a license or blow into a machine. Be made to confront his addiction as well.
