I have heard some reasoning as to why 'losers" in lawsuits should not foot the entire bill.... best reason IMHO - legitimate, (non frivolous), suits would be impeded for many due to this. (If I am understanding the law correctly... I'm coming outta left field on this one so set me straight if I'm in error)...
But that's totally unfair, IMHO. WHILE admitting that the 'impediment to legitimate lawsuits needs to be factored in. Seems to me if I win in a lawsuit I should be out ZERO dollars... which, it seems to me, would go a LONG way in helping the 'little guy' who wins or loses against "MEGA" lawyering up which some can afford, (sometimes simply to intimidate you into dropping your case or defense).
