Anything can "play a factor" when it comes to a trial. The issue is will we be dealing with a criminal trial or a civil trial. Regardless there will be expert film safety experts who likely will testify that while many others bear responsibility for what happened the last person with the weapon in his or her hand is also required to re-check the weapon (in this case the "gun"
before the action begins.
On thing to keep in mind: there were at least 6 and possibly 7 individuals responsible for what happened here. 1) the -whatever you call it-who decided for cost reasons to use an actual firearm instead of either a dummy or expensive CGI -having to pay for computer engineers, etc.; 2) the procurement person in charge of actually obtaining the gun from someplace; 3) the person in charge of maintaining the gun in a secured place; 4) the actual person in charge of making sure the weapon was safe to be used on the set; 5) the past person before Baldwin to check the weapon to make sure the projectiles, if any, were safe for the surroundings around the particular shoot sequence and transfer it by hand to Baldwin; 6) The person in charge who made the decision to have most of the above used by one person instead of having someone particularly trained for the position ( again cost saving); 7) The person with the gun when the rehearsal began-namely Baldwin himself who was responsible for making sure there were no projectiles that would injure or kill someone-regardless of how much he knew about gun safety-hence the argument of relying on the expert roles in this sequence.
And of course there was us. We want more and more movies that come as close to reality as possible. And the corporate stakeholders who want as much money from us as they can get.
Filmmaking that involves action has become more and more dangerous for not just the actors but also everyone on the set-hence the reason liability and workmans compensation insurance rates are so high in the industry (another reason that explains cost cutting and making movies we all want).
