Uh-Oh...Looks Like 9'er Fan Caught A Beat Down

I hope that he's OK and the perpetrator(s) are caught. This isn't a good look.

49ers Fan In Coma After Apparent Beating Outside SoFi Stadium During NFC Championship

BY HARRIET RYAN STAFF WRITER
FEB. 2, 2022 UPDATED 7:28 PM PT

Police are investigating the apparent beating of a San Francisco 49ers fan found severely injured in the parking lot of SoFi Stadium during Sunday’s NFC championship game against the Rams.

Daniel Luna, a restaurant owner from Oakland, remains hospitalized at Harbor-UCLA Medical Center in what Inglewood police said was a medically induced coma.

Luna, 40, was discovered on the ground by Los Angeles Fire Department paramedics in the stadium’s Lot L about 4 p.m., half an hour into the Rams-49ers contest, said Inglewood Police Lt. Geoffrey Meeks. Luna was wearing a San Francisco jersey and black pants, Meeks said.

Emergency room staff at Harbor-UCLA noted wounds suggesting Luna had been attacked and contacted Inglewood police later that night.

“They believe he suffered from an assault at the stadium to his upper body and facial area,” Meeks said. Detectives are working with stadium officials to determine what happened to Luna, he said.

“We are relying heavily on video to try to identify the people involved,” he said. “We are going to leave no stone unturned.”

More than 70,000 people were on hand Sunday to see the Rams best the 49ers 20-17 to advance to the Super Bowl, which SoFi Stadium will host Feb. 13. So many San Francisco fans were expected that the wives of some L.A. players campaigned on social media to give away tickets to Rams supporters.

A spokeswoman for the stadium declined to comment on Luna’s case, citing the police investigation.

Luna grew up in the Bay Area and owns a Peruvian fusion restaurant, Mistura, on Piedmont Avenue in Oakland, according to published reports about the restaurant. Its website Wednesday indicated it was temporarily closed. Luna’s wife was at the hospital with him and, she said in a brief phone call, too upset to speak.

Luna flew to L.A. and attended the game alone after other fans who were to accompany him canceled, said Vernon Hill, a friend from Oakland who is in touch with his family. He said Luna usually chronicled his outings in photos and shared them with friends and relatives, but they did not receive the usual pictures Sunday night.

He said that Luna still had his watch, wallet and phone when taken to the hospital, suggesting robbery was not a motive. Police said they could not confirm those details.

Until The Times sought to confirm Hill’s account, authorities had not released a public statement about the attack.

“I don’t want this to happen to anyone else,” Hill said. “They are having the Super Bowl there.”

The circumstances of Luna’s injuries shared some similarities with one of the darkest days in L.A. sports history, the brutal 2011 beating of San Francisco Giants fan Bryan Stow in the Dodger Stadium parking lot. Two men were convicted in the attack that left Stow, a paramedic, with brain damage.

Meeks said that thus far in the investigation, “we have not come across any information” suggesting Luna was targeted for being a 49ers fan.

People are paying hundreds to thousands of dollars to attend theses games just to have the experience tarnished by a bunch of drunk idiots. I was at the NFC championship game and a drunk Rams fan dropped his pizza and beer on an older couple in front of him. He then proceeded to fall down onto the people in front and in back of him several times throughout the game. It's a shame people have to endure such behavior.
Update: Man Charged With Felony Battery In SoFi Stadium Altercation; Victim Out Of Coma

Man charged with felony battery in SoFi Stadium altercation; victim out of coma

BY RICHARD WINTON STAFF WRITER
MARCH 9, 2022 7:11 PM PT

A 33-year-old man arrested last month in connection with a SoFi Stadium parking lot altercation that left a San Francisco 49ers fan in a medically induced coma has been charged with battery, prosecutors said Wednesday, and the 49ers fan has come out of his coma.

Bryan Alexis Cifuentes faces one felony count of battery with serious bodily injury in connection with the assault in the Inglewood stadium’s parking lot during the Jan. 30 NFC championship game between the Rams and the 49ers.

“We want to continue to ensure that our sporting events are safe for everyone,” Dist. Atty. George Gascón said in a statement. “We will not tolerate violent behavior at what should have been a joyous occasion for our county.”

After the 49ers fan, 40-year-old Daniel Luna, approached a group of people watching the game in the parking lot, prosecutors said, Cifuentes knocked him out during a confrontation and then fled.

Inglewood Mayor James T. Butts Jr. said last month that video shows people mingling in the parking lot when Luna pushes another man — later identified as Cifuentes — from behind.

The other man pushed Luna back and then struck him in the face, Butts said. Luna fell to the ground and hit his head.

Police traced Cifuentes’ address in Los Angeles after surveillance video showed his car in the stadium lot, providing a license plate number, Butts said. They left contact information at his home.

Cifuentes later contacted police but declined to come to the department to be interviewed, Butts said. Officers then went to his workplace in Montebello, and he “voluntarily accompanied them to the Inglewood Police Department” and was taken into custody Feb. 3, the mayor said.

Cifuentes is scheduled for arraignment Aug. 29 at the Inglewood Courthouse.

Luna was hospitalized after he was found bleeding in the parking lot about half an hour into the game.

A spokesperson for Luna’s family said Wednesday that the Bay Area restaurateur had come out of the coma and was expected to be released from the hospital into rehab this month.

Luna is the owner of the Oakland restaurant Mistura. He flew to L.A. and attended the game alone after other fans who were to accompany him canceled, according to a friend.

Officials faced scrutiny for not informing the public about the incident for several days.

It took three days and an inquiry from The Times before authorities acknowledged the incident. Inglewood Police Lt. Geoffrey Meeks denied there was an attempt to cover up Luna’s beating in the run-up to the Super Bowl, which SoFi Stadium hosted two weeks later.

“We don’t have anything to hide,” Meeks said, stating that the department’s silence was in keeping with standard practice for ongoing investigations.

Law enforcement experts said it was unconscionable for authorities to delay revealing the incident.

“You should put out that information to the public because the perpetrator is a public safety hazard and threat to the community,” said Horace Frank, a former assistant Los Angeles police chief who oversaw major game security operations.

The incident drew comparisons to the infamous 2011 beating of San Francisco Giants fan Bryan Stow outside Dodger Stadium.

Butts said it was inaccurate to liken the incident at SoFi to what happened to Stow.

“The situation in Dodger Stadium is nowhere comparable to this,” he said, “and to be blunt about it, it looked like a small altercation that went very bad…. It wasn’t like you had people ganging up on somebody and beating them.”

Butts said a security guard called paramedics very shortly after the altercation. He said he was not concerned about security at the stadium.

LA Times

First assuming the 49er fan initiated this mess by "pushing" the guy. (and of course none of know what led up to this or whether he did push the guy-and that includes me) If Niner fan did push the guy unprovoked he can be charged with a battery and there are degrees of battery. However, even if the guy who was arrested was not the aggressor his response has to be "reasonable" in that he must have a reasonable belief the force he displays is necessary to protect himself from some imminent violence. Moreover, and this is critical, whatever force he uses must be proportionate to the force used against him.

An often used example in Criminal law classes is this: assuming a drunk guy at a bar doesn't like how you are looking at his girlfriend and "shoves "you on the shoulder you are not justified in breaking a bottle over his head or even justified in punching him, or slapping him, or kicking him in the goodies.

And it doesn't matter if the punch you throw wasn't intended to even cause serious trauma the result is what counts because that result came from an unlawful response to being pushed.

Now assuming this 49er fan unfortunately dies I can see charges ranging anywhere from involuntary manslaughter, voluntary manslaughter, second degree murder. What is not likely to go well with the charging D.A here, in figuring out what, if any, charges to file is the fact that the guy left the scene without seeking help for the guy unconscious on the ground and now in a coma fighting for his life. This is important because if he's convicted or pleads out the sentencing judge looks to whether is evidence of remorse and or taking responsibility. Leaving the scene after knocking someone out and who is on the ground in that condition doesn't meet those criteria.

Updated Info

Suspect Arrested In SoFi Stadium Assault That Left 49ers Fan In A Coma

Officials said a suspect in the beating outside SoFi Stadium on Sunday has been taken into custody but provided few additional details.

BY HAYLEY SMITH, RICHARD WINTON, HARRIET RYAN
FEB. 4, 2022 UPDATED 10:44 AM PT

A suspect has been arrested in connection with the SoFi Stadium attack that left a San Francisco 49ers fan in a medically induced coma, officials said.

Bryan Alexis Cifuentes, 33, was arrested Thursday night on suspicion of “assault by a means to produce great bodily injury,” a felony, Inglewood Mayor James T. Butts said during a news conference Friday morning.

Police traced Cifuentes’ address in Los Angeles after surveillance video showed his car inside the stadium lot, providing a license plate number, Butts said. They left contact information at his home.

Cifuentes later contacted police but declined to come to the department to be interviewed, Butts said. Officers then went to his workplace in Montebello, and he “voluntarily accompanied them to the Inglewood police department” and was taken into custody.

He was released in lieu of $30,000 bail at 1 a.m. Friday, Butts said.

The injured fan, 40-year-old Daniel Luna, was hospitalized after he was found bleeding in the stadium parking lot about half an hour into the Rams-49ers showdown on Sunday.

Officials faced increasing scrutiny this week for not informing the public about the incident for several days.

Butts on Friday said video had emerged showing people mingling in the parking lot when Luna, wearing a white jersey “that some think was a throwback 49ers jersey,” allegedly pushed another man — who was wearing a yellow jersey believed to be a Rams jersey — from behind.

The other man then pushed Luna and struck him in the face, Butts said. Luna fell to the ground and hit his head.

As of Friday morning, Luna’s condition had not “improved or deteriorated,” Butts said.

A source with the Inglewood Police Department told The Times that Cifuentes is claiming self-defense. Butts would not say whether Luna would also face charges for the altercation, noting “that would be up to the District Attorney’s office.”

“They will look at the totality of the circumstances and they will make their decision,” he said, adding that it doesn’t appear from the video footage that anyone else was involved in the altercation.

Luna is the owner of Oakland restaurant Mistura. He flew to L.A. and attended the game alone after other fans who were to accompany him canceled, according to a friend.

Luna’s wife, reached at the hospital on Wednesday, said in a brief phone call she was too upset to speak.

Inglewood Police Lt. Geoffrey Meeks denied there was an attempt to cover up Luna’s beating in the run-up to the Super Bowl, which will be held at the stadium on Feb. 13. It took three days and an inquiry from The Times before authorities acknowledged the incident.

“We don’t have anything to hide,” Meeks said, stating that the department’s silence was in keeping with standard practice for ongoing investigations.

Law enforcement experts said it was unconscionable for authorities to delay in revealing the incident.

“You should put out that information to the public because the perpetrator is a public safety hazard and threat to the community,” said Horace Frank, a former assistant Los Angeles police chief who oversaw major game security operations. “You want to get the persons responsible for this heinous attack into custody as soon as possible.”

Butts on Thursday similarly denied that Inglewood wanted to hide Luna’s injuries.

“Absolutely no, you don’t notify anyone every time you have an injured person…. There are all types of injuries that occur in crowds and you don’t call and hold a press conference to everyone,” he said.

The $5-billion stadium, which opened in 2020, has largely been seen as a boon to the community. The Super Bowl is projected to bring in as much as $477 million for the Los Angeles area, with total tax revenue up to $22 million, according to recent reports.

Sunday’s game, which saw the Rams best the 49ers 20-17 to advance to the Super Bowl, was attended by more than 70,000 people — including Gov. Gavin Newsom and Los Angeles Mayor Eric Garcetti — but so far no video footage of the incident has been made public.

“I don’t think there’s anything to worry about,” he said. “The reality is this was a ... two-shove, one-punch altercation. The greatest damage was done because he landed on the back of his head on the pavement, so I don’t think this has any implications for safety.”

On Wednesday, hours before The Times revealed Luna’s injuries, public health officials, local leaders and representatives from the NFL and SoFi Stadium held a news conference to discuss COVID-19 safety protocols for the Super Bowl, but the incident with Luna was never mentioned.

In a statement to The Times, SoFi Stadium officials said they were “aware and saddened by the incident” and “working with law enforcement officials.”

The 49ers expressed a similar sentiment.

“What happened to Daniel Luna is reprehensible, and we strongly condemn all violence. We know local authorities in Los Angeles are conducting a full investigation and we’re here to support them however we can,” the team said in a statement.

LA Times
